Welcome to CareCommons. These Terms of Service (“Terms”) govern your access to and use of the CareCommons website, applications, and platform services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Services.
1. Eligibility
You must be at least 18 years old and authorized to act on behalf of your agency to use the Services. If you use CareCommons on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of services
CareCommons provides a multi-tenant software platform for home care agencies to manage clients, caregivers, schedules, care plans, visit verification, messaging, billing, and reporting. Features and availability may vary by subscription plan.
3. Account registration and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify us of any unauthorized access or security breach. Agency administrators are responsible for managing user roles and permissions within their agency.
4. User responsibilities and acceptable use
You agree to use the Services only for lawful purposes and in accordance with these Terms.
- Provide accurate and complete information when creating accounts and records.
- Use the Services only for authorized agency operations and client care.
- Maintain the confidentiality of client information and comply with applicable laws.
- Do not attempt to access data belonging to another agency or user without authorization.
- Do not reverse engineer, scrape, or disrupt the Services.
- Do not upload malware, spam, or unlawful content.
5. Data and privacy
Client and user data are stored and processed according to our Privacy Policy. Agencies are responsible for obtaining appropriate consent from clients and caregivers to process their data in CareCommons. We implement access controls and row-level security to isolate data by agency and role.
6. Intellectual property
All software, designs, trademarks, and content provided by CareCommons are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from our content or software without written permission. You retain ownership of your own data uploaded to the platform.
7. Payment and billing
Fees for paid plans are described in the applicable order, invoice, or subscription agreement. Payments are due as specified. Failure to pay may result in suspension or termination of access. All fees are non-refundable unless otherwise agreed in writing.
8. Third-party integrations
The Services may integrate with third-party tools or APIs. We are not responsible for the availability, accuracy, or policies of those third-party services.
9. Termination
We may suspend or terminate your access if you violate these Terms or if required by law. You may terminate your agency account at any time by contacting us. Upon termination, your right to access the Services ceases, and we may delete or retain data in accordance with our data retention practices.
10. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure. CareCommons is a software tool and does not provide medical, legal, or professional care advice.
11. Limitation of liability
To the maximum extent permitted by law, CareCommons and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Services. Our total liability for any claim shall not exceed the amount paid by you for the Services in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless CareCommons and its affiliates from any claims, damages, losses, or expenses arising from your use of the Services, your data, or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction where CareCommons is operated, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. The latest version will be posted on this page. Continued use of the Services after changes constitutes acceptance of the revised Terms.
